Tonight, on our midninght shift, (I work evenings) one of the CNA's said "I can't handle this crap, I'm leaving" and walked out.  I know that it's abandonment for an RN or LPN to leave during a shift after they've accepted an assignment and report, but is it abandonment if a CNA does it?  Also, one of my co-workers from evenings was mandated for 4 hours during this same night, and she and the nurse agreed on 3 hours, which meant that she was leaving at 2am.  The CNA that walked out, left at 1:50am, and they tried to tell my co-worker that she had to work the remainder of the shift.  We know that if we refuse mandatory overtime at the end of a shift, that it's not abandonment, but could my co-worker that left after her agreed upon overtime be charged with neglect?  I can't find anything on MI laws regarding CNA's, but other forum's that I've read say that CNA's can't have their license/certification revoked for abandonment, and that if they do leave, it is the nurse's responsibility to fulfill their duties.  I'm not sure if the same laws regarding abandonment/neglect pertain to CNA's.  Anyone know of a CNA having their certification or license revoked?

  • Wow, 1st of 4 all, I'm sorry for your situation.. As far as the law goes, I do believe that different states have different laws. I would imagine that there would be ramifications for an abandoment of a shift..Even if your this behavior follows you for the rest of their career.. Please keep us posted... Teresa
