Multiple part answer.


In general - Yes.  If the situation is a dire emergency for which your facility does not have the capacity to care for the patient.


Specifically, you need to know what your Policy and Procedures Manual says about such cases.


I am not a lawyer and cannot give you a definitive answer, but to err on the side of caution is more likely to have a happy outcome (i.e., if the situation warrants it, call 911.  When you are standing in front of the board of nursing or judge or whatever, I would rather defend  myself against how I pissed off a supervisor, than how my inaction killed a patient.)

Yes you are right.  The sad part in all of this is the resident never received the care she has a right to.  All because my former supervisors thought she was attention seeking and wanted a vacation,  Odd I was terminated for calling 911 and they both have their jobs and they denied this poor lady treatment.  Just because they felt they had a right  to do what ever they felt fit.  Because they keep getting away with neglect, abuse and malpractice.   And will continue to get away with abuse as long as they terminate those who care and could blow the whistle as one says.

Do you have an attorney? 


Have you discussed with such attorney, the whistleblowers act ?  (Either Federal or state level [if the facility receives Medicare funds, and most do, I think you could take it to a Federal judge]).


May be what you need right now.

Thank you everyone  for your thoughts and advice.  I had a job interview yesterday for a Wellness Director Position.  I think it went well.  Hopefully I will get hired and can start fresh.  And this time I ask more questions.  I wish I would have ask more questions when I interviews for my last position.  I most likely would have turned down the job and would not be in this mess.  Wish me luck.

I was offered a new job today.  A better job taht I was terminated from.   I am still sueing them for wrongful termination.  However, if those idiots would not have fired me I would not have interveiwed and been offered this awsome job.   Thank You again for your words of encouragement and your kindness.  Just being able to vent made me feel better.

Congratulations on the job offer.


God opens a new door when one closes.  The same thing happened to me once and the outcome was that I was picked-up in a division that I had always wanted to work in and they paid for my MPH from Johns Hopkins and gave me a base to finish my PhD.


Enjoy the new job and please keep us informed on the lawsuit.  It may help others in the future.  I know that I have talked with at least one other nurse, same situation and I am praying that she has a similar outcome.

I just wanted to give you an update on my new job. It is awsome, I havebeen on the job for alittle over a week and I have hired 3 people. havebeen included on all management issues.  What a difference between jobs.  My last employer/ supervisor would not teach me anything. Would not include me in any thing.  Wrote me up for things that she failed to train me for and then terminated because I called 911 for a client.  My former employer did me a hudge favor by firing me. However, the law  suit goes on.

Hello everyone I just heard today that my former employers are on a provisional license. And the state is investigating them for violationg the residents rights amd misapropreation (not sure if I spelled it right) of funds.  LOL. I quess my complaint to the state worked out.  Maybe the  place will shut down and the residents can live in a place that cares.

Just an FYI my lawyer served them with wrongful termination papers today. I also found out that they can not admit any new residents until they get their acts together. Will keep you updated

As it should be.  Admitting more patients could be dangerous and would be a reward for their behavior.  Makes one smile to think about it.


Good job.  Glad that you had to courage to act on the problem and were rewarded by God for your efforts.

Just an FYI I won my case. They settled.  I also heard that they have more lawsuts agaist them.  I still do not understand why the masnagers in this company still have their jobs. Oh well, I won.

A HUGE CONGRATULATIONS TO YOU AND THE RESIDENTS YOU HAVE HELPED !!!!!!!!! 


That actually went fast as far as court cases go.  Wearing a white hat does pay off in the end.


Keep an eye on the place.  I see one of two things happening: 1) they get new upper management who will recognize the problem people and let them go or 2) the place will fold altogether.


You did really well throughout all of this.  I know it seems tough when it is happening.  By bringing the problems to us, we made our own little think-tank for the problem and you picked and choose the advice you could use.
