Posted over 4 years ago I was wondering if anyone could help or offer some advice. I graduated from nursing school on May 2008. I did a work-at-home job online in 2007. Where you processed invoices, stuff envelopes etc....I was paid with travelers checks. I cashed them at the post office and the bank each time they had work for me. $3000.00 was the total amount. I only did it for a month before finding out they where counterfeit. A year later meaning March of 2008 i was inditied on possession of counterfeit securties. I had no idea the cheques where counterfeit. I know you can't have a felony. It would have been stupid for me to jeapodize my education. So, before anyone says otherwise. I am aware of this. I am now in the process of waiting to see what the outcome will be from the nursing board. Has anybody had any felonies that knows what the outcome may be? Thanks for your help, and God Bless! |

| Posted over 4 years ago Wow, I am so sorry you're going through this and I have no idea what to say except good luck. LawyerRN is a really smart guy............he would be someone on here that could say something that makes sense. My mom owns a business and has had to go to court for bad checks they recieved.............I think she said any amount over $500 could be considered a felony. Do NOT quote that........my mom is fabulous travel agent but I cant understand a word she says half the time when it comes to business stuff............and my daughter balances my checkbook for me. By getting so far in your education, I'm sure your a great person and I do hope you have a good outcome on this.............Im serious, LawyerRN is a smart dude.Why not email him? | Posted over 4 years ago Every state is different regarding what constitutes a 'felony,' and also in the licensure requirements for nurses. In some states a disqualifying conviction must be a felony of a certain type, such as "involving moral turpitude." Have you been convicted, or just indicted? If not convicted yet, the prosecutor might plea the charge down to a lesser offense (which might be only a misdemeanor), especially if your record is otherwise clean. I'll try to check it out further. Your Board of Nursing will know more about what constitutes a disqualifying offense. |

This is from the Alabama Board of Nursing website: "Question: Can a person obtain a license as a nurse with a misdemeanor or felony conviction? Answer: Each applicant is evaluated on a case by case basis. The Board of Nursing considers the nature, severity, and recency of the offense, as well as rehabilitative efforts and other factors. The Board cannot make a determination for approval or denial of licensure until the entire application and supporting documentation is received and reviewed."
So, a 'felony' is not an automatic disqualifier. As this is a nonviolent offense, and does not involve moral turpitude, I think you have a very good chance of coming out of this o.k., especially if it is a first offense. If not convicted yet, try to get it down to a lesser charge. Let the prosecutor know that your future career depends on this. If you have been convicted already (a guilty plea is exactly the same as a conviction), then plead your case before the Board of Nursing. Good luck! |

| Posted about 4 years ago OMG I am so glad to have found this site. I am an RN with a felony, and I have been employed ever since the conviction for posession of a controlled sub. I have a disease, and thank GOD my BON recognizes this. There is action against my license. But as long as I continue to excel in the nurse's monitoring program I belong to, I will retain my license. It is a five year program, and I feel it is a blessing. The positions I have been offered are not positions I would ahve ever considered before getting into trouble(my background is in ED), but they have kept food on my table. I would love to ask LawyerRN a question, however, and I pray he is still on this site. One of those jobs I referenced was bad bad bad, and the doc, I assume, thought he could get away with being a crook and that I would turn a blind eye. What he failed to recognize is that 12 Step Programs tend to render a person better than before, and I had to advocate for patient care. I reported him to the DOH, and he has retaliated. Lawyer RN, are you still out there?
