The six year old is a Juvenile and hence under a different law system altogether. He is not even eligible in any states to be tried as an adult. The core of his difference in this compairison is that he is in the beginning stages of development, where as the police officer is a grown adult (i.e. fully developed) who has proven to have developed poorly. I would agree that the six year old has to be monitored, punished, and redirected over the streach of his further development, but the police officer is polluted for the rest of the game, and needs prayers and a big grown-up armed babysitter for the rest of her days on this earth.

I'm not a psych nurse so I am curious to know, how do we verify with accuracy that an individual actually has a mental illness and this is a valid defense in these types of cases? ~ Laugh as much as you breath and love as long as you live ~ |

I am pretty sure that KILLING a CHILD... and EATING it's BRAIN.. is what is called PRIMA FACIE evidence the woman was completely freaking NUTS.
OK I will give you she might be completely normal... BUT.. the sheer dedication to purpose she demontrated by EATING PART OF A CHILD'S BRAIN...is impressive.. I think by showing THAT much dedication to a plan to actualy canabalize her own child.. what the hell.. even if shes not not crazy.. she should be allowed to use the insanity defense out of respect.
I have to admit your post is actaully something I would have posted sarcastically.....and I appologize if it was meant as humor.. but I have read many of your posts and I have never seen this level of humor.. Hats off if it was posted as a joke.. If you were serious...I am frightened.

I have absolutely no desire to fall into the middle school mind games that you so obviously love to engage in. Did I say that I felt she was NOT crazy? No, I did not. In fact, in an earlier post I stated just the opposite. I personally feel this female should be looking at life in prison, or worse. My question was a valid one. Just going to court and saying someone is crazy based on acts committed is not enough, there has to be proof of this by way of medical evaluations. So, back to my original question, what process is used when evaluating an individuals mental capacity? No one can actually tell if someon is actually insane..... even f-MRI's are controversial...... BUT.. if this woman did what she did... I think any SANE person would take it as evidence a person is CRAZY..... although eating the brains of the deceased in Micronesia was an excellent case study in epidemiology regarding the spread of a prion disease called Kuru.
In answer to your question there is no 100% way to tell if a person is crazy... but in THIS case i am inclined to think she deserves a pass from the ciminal justice system.
As for life in prison or worse.... what EXACTLY is worse? The death penalty?? If she is INSANE? That has been tried before... and no, I am not talking about Texas.... with some not so desireable results....can you say Nurenburg Trials? |

| Posted over 3 years ago it is still a shock to know that some still doesnt understand that being mentally sick is different from lets say being physically sick, its the thinking that blaming the person, for the wrong thing she had done, when she herself is not capable of thinking what is right or wrong, what is true or not. No one in her right mind would choose to kill her own baby and eat the same! Do we really need to have an indepth study about the case.?! Can we not qualify killing a baby and eating its brain an act of an insane or mentally disturbed person?! Then how do we call that, just her trip to kill her baby and have her brain as her dinner?! I never said she wasnt insane. She is. What I am saying is she should not ever be let out into society again. Ever. Plain as that, because she may very well do somehting crazy again. You cant fix this kind of thing. You can try with meds......but, and again I will say it for those that chose to ignore my statement.... She was on meds prior to this incident, and for some reason, stopped taking them. It is completely unsafe! Yes, she is insane, I never doubted that for a second, but darn throw away the fricken key! | Posted over 3 years ago No different than Andrea Yates, who killed her five kids (in Texas too?). Hubby had to write a paper about Andrea Yates for his Abnormal Psychology class. I'm guessing this was all related to postpartum psychosis? My biggest concern would be that she is never allowed to have a child ever again. (yes, they get pregnant in psych wards, and in prison too) |

| Posted over 3 years ago Actually she was a diagnosed schizophrenic sometime before she got pregnant. Her family had voiced their concerns about her more than once. Apparently she went off the meds (fairly typical of unmonitored schizos) and had this baby. One thing that bothers me is she decided to call 911 so I have to question whether she was truly "out of it". |

Look, I am not insinuating that this female is not way beyond what we would deem as normal. Dear God, it is amazing how so many people twist what is said on here. My point, and I will reiterate it again because evidently you didn't read any posts after this one, is that you cannot just waltz into court and tell a judge that YOU feel someone in mentally impaired....you have to show MEDICAL EVIDENCE of such things. The question was HOW is ones mental capacity evaluated, and I wanted to read a response from someone who had experience in psych. I never once second guessed whether this person had severe mental issues. Furthermore, there are many documented cases of cannibalism in which people were not mantally impaired. Now before you twist that into something else, let me clarify by saying NO I do not condone cannibalism, but it has happened as a mode of survival in civilized societies and still happens in other societies and is considered quite normal for them. ~ Laugh as much as you breath and love as long as you live ~ |

Aside from that, of course you need medical evidence to prove that the person is mentally ill, but aside from medical evidence you were asking, this kind of crime could not deny the fact that this is indeed a clear form of insanity. Also there were many cases like this that happened before .Postpartum depression and psychosis have been cited as contributing factors in several other cases in Texas in recent years in which mothers killed their children. Andrea Yates drowned her five children in her Houston-area home 2001, saying she believed Satan was inside her and trying to save them from hell. Her attorneys said she had been suffering from severe postpartum psychosis, and a jury found Yates not guilty by reason of insanity in 2006. "happiness depends upon ourselves" |

ONCE AGAIN you avoided the question, which was, how is one evaluated? What means is used to determine this? And ONCE AGAIN I am not saying this woman is not a nut job, but AGAIN saying that it is so doesn't hold up in court. ONCE AGAIN, I did not indicate that this person was into cannibalism, I was simply stating a fact, that there are documented cases of people who did eat other humans who were NOT mentally impaired. I'm well acquanted with the Andrea Yates case and her diagnosis. She got off easy.

| Posted over 3 years ago There are so many available information on the web that you can read maa'm on how a mental patient is being evaluated, a series of questions, tests, etc, etc can help identify if a person is to be considered mentally ill. One of which is the "medical clearance" of psychiatric patients, it is the initial medical evaluation of patients in the emergency department (ED) whose symptoms appear to be psychiatric in origin in order to determine whether serious underlying medical illness exists which would render admission to a psychiatric facility unsafe or inappropriate. Yes, we can explore a lot of possibilities into this case, your mentioning of cannibalism in your previous post (since it is really a fact that there is such thing) can also be considered, but basing on this person's hx, she was perviously diagnosed mentally ill and depressed and so I'M saying, i think in my own opinion, cannibalism is out of the question in her case. i did not say it was You indicating that. | Posted over 3 years ago Oh dear - two of my friends going at it here... Remember, sometimes that which is perceived as condescending may really be because of a language difference! I speak Tagalog and German, but wouldn't DARE post something in those languages! So anyone who is at least understandable in English, for whom English is not their first language, has my utmost respect! Now for the aspects of the case. I worked as a psych nurse for three years, in the worst locked-down facilities, including the State prison for the criminally insane. I have also been an attorney for 24 years. There is not just an "insanity plea." You need to show that you, at the time of the offense, did not know right from wrong! The other possibility is that you are too crazy at the time of trial to understand the matter, and assist in your own defense. If you are found NGRI (not guilty by reason of insanity) you will probably be reviewed by a judge every 6 months. to reexamine appropriateness of restraints on liberty. In other words, they can let you go if you are no longer dangerous. BUT, believe me, the psychiatrist who makes the recommendation is VERY reluctand to recommend relaease. I've asked psychiatrists, who recommended continued incarceration, why they didn't think the patient should be released, altho showing no signs of being dangerous. The answer: "You're kidding! If I let him go and some day he snaps again and kills somebody, I don't want my name in the paper!" I agree - if you know psych meds, you know that when the patient is released, and they don't like the side effects and stop taking the med, they go back to the crazy behavior. Then hopefully they go back inside before someone gets hurt! So my opinion in this case: First, the woman was obviously insane at the time of the crime - but did she know right from wrong? If she did, then life with no parole. If she didn't, then Involuntary commitment, and STAY THERE forever! And by the way: The prison / hospital for the criminally insane in NJ (at least when I was there)? No country club! They are all in cells, drab, cold, just like out of a Jimmy Cagney movie. Yes, they are out a few hours a day, but I was creeped out just being there for eight hours!
