Posted 17 days ago Hello, Everyone.. I have a serious question because I'm thinking of filing charges....i work for a SNF..the dress code requires all nursing staff to wear white..I don't have a problem with that. The problem is all female nurses have to wear a cap that looks like its part of a french maids attire. The policy says "All nursing staff in white with cap to distinguish between nursing assistants and register/licensed staff", but the male nurses don't have to wear anything on their heads. I consider this gender discrimination, and violation of my constitutional rights. I'm debating calling the EEOC. Will this be a waste of my time and effort? To preserve woman rights? What do you think? I'm really bothered by this. I refuse to wear it, but since I work the night shift I don't have to..I was asked to work the morning shift and refuse to wear the hat, then my shift was giving to another coworker. What should I do? |

| Posted 17 days ago Hi, you must be kidding? You are going to fill what against whom? Quick Google: Direct discriminationDirect discrimination occurs when a person is treated less favourably than another in a comparable situation because of their racial or ethnic origin, religion or belief, disability, age or sexual orientation. Indirect discriminationIndirect discrimination occurs when an apparently neutral provision, criterion or practice would disadvantage people on the grounds of racial or ethnic origin, religion or belief, disability, age or sexual orientation unless the practice can be objectively justified by a legitimate aim.

Against the facility owner/administrator...so, there's no law against gender discrimination? If the male nurses' don't have to wear it...why should I if I want to work day shift or evening shift? that's my point...the male nurses don't have to put it on there heads, makes me feel uncomfortable, seem company feels men are superior...just asking questions cause it makes me so uncomfortable. I'm the only one speaking out but most female staff are saying in private the same thing. And, I'm not kidding and thank you for the direct/indirect definitions. Just curious on how other people feel about this....seems this is putting woman back regarding equal right 100 years. .

| Posted 16 days ago That is bogus for sure. Put some heat on them if you can afford the hassle as that is wrong. |

| Posted 15 days ago I dunno. I guess if that's a hill you're willing to die on. Maybe instead of "charges" you could suggest other ways of discerning the disciplines in your facility. |

| Posted 15 days ago this is def not a hill worth dying on!!!!go to kay's caps on line and look at their nursing caps they have about 100 tell your DON that you will wear a real nursing cap not some ripoff french maid uniform crap cap and then mention that the DHS has closed over 50 nursing homes this past year for failing to meet national pt safety goals re : patient falls; UTI's r/t poor foley care;medicare fraud and host of other issues re quality care ! so one might be prudent to spend more time making sure your facility is meeting all these standards before enforcing a dress code which will do nothing to keep the DHS from closing the doors permanently to your care facility! |

| Posted 15 days ago Discrimination based on a protected class (like gender) is generally actionable, but I would not bet on an action based on dress code, if reasonable. For example uniform and grooming standards in the military are different for men and women. (I am an attorney, but this does not constitute legal advice) By the way, was this policy written in the 1800's???? |

| Posted 15 days ago Thank you Kellyj..My point exactly..its not going to make my nursing care no better ..but patient care could be better, like we had no linen for noc shift but the issue was blamed on CNAs throwing linening away, when I see CNAs bringing in their own supplies for providing proper care like depends, soap, smell goods. I totally said the same thing..The administrator/owner says, its from a prestigous nursing school in boston. I told him, I'm not in nursing school, but thank you all for your input..I actually received a position from another facility..future looks brighter. AND I NEVER PUT THAT HAT ON....LOL LOL LOL One for woman RIGHTs......OORAH!!!! (husband is a marine) lol

I think it was lol lol ....it just felt so wrong. I actually got upset because I was asked to wear it during an overtime shift...I refused and kept working providing star care to my patients. Thats all that matters.
