Posted about 3 years ago is it a conflict of interest when a caregiver in a nursing home gives special attention to a patient with a promise from the spouse that they will compensate her with a monetary award either before or after the death of the patient. |

| Posted about 3 years ago It's not necessarily a "conflict of interest," but it is unethical and if I were the administrator I would discipline the employee. If the caregiver does that, they are acting as a private duty aide while accepting pay from the facility. If the facility agreed, the aide could work separate hours as private duty, compensated in any way the family wishes. But to give one resident better care than the others while on the facility payroll is unethical and immoral. While being paid by the facility all assigned residents must receive equal attention. In fact, as the former State abuse prosecutor, I would have charged the caregiver with neglect - neglecting all the other residens in exchange for future monetary gain.
